[LINCOLN] Logan & Lincoln Bill Re: 1847 Lawsuit

Manuscript document. Sangamon County, Illinois, 2 March 1847. 1 page, folio, docketed to verso. 

 

A notarized itemized bill issued by Abraham Lincoln and his legal partner, Stephen T. Logan, to James D. Smith. The costs date from October and November 1845 and include travel expenses, filing costs, and other fees. Totaling $21.50, the bill is notarized by the Clerk of Sangamon County, John Calhoun. 

 

This bill was compiled for a lawsuit regarding an earlier case when Logan & Lincoln's fee was not collected: "Lincoln was probably reminded of the case when it became necessary for Logan & Lincoln to file suit to collect their $100 fee from the executor of William Trailor. They had failed to take a note of the fee and Trailor had refused to pay. James D. Smith, his executor, refused payment on the ground that the claim was not filed in time. Logan & Lincoln in July, 1845, brought suit in the Sangamon County Circuit Court and got judgement on November 19th, but failed to collect. Three years later they brought the case before the probate justice of Warren County, who ruled in favor of their claim, and ordered the executor to pay Logan & Lincoln $110." (Harry E. Lincoln joined Stephen Logan in a legal partnership in 1841. Logan maintained the practice in Springfield while Lincoln traveled the Eighth Judicial Circuit. They dissolved their practice in December 1844, when Logan opened a practice with his son and Lincoln opened his own practice, soon partnering with William Herndon, who had clerked in the Logan & Lincoln law office.
